1. Acceptance of Terms
By accessing and using the ByteBooks Operating System ("Platform"), you agree to be bound by these Terms of Service. ByteBooks (operating as Nocha Enterprise) provides unified commerce, point of sale, inventory automation, and financial ledger services. If you do not agree to these terms, you may not use the Platform.
2. Enterprise Licensing & Access
Access to the Platform is granted on a per-seat or per-organization enterprise licensing model. You are responsible for maintaining the confidentiality of administrative credentials and for all activities that occur under your organization's tenant. Unauthorized sharing of access credentials or bypassing licensing limits may result in immediate suspension of service.
3. Data Ownership & Processing
You retain all rights and ownership to the business data (inventory, sales, financial ledgers) you process through the Platform. ByteBooks is granted a limited license to process, store, and analyze this data strictly for the purpose of providing, maintaining, and improving the Platform's predictive analytics and operational engines. We do not sell your operational data to third parties.
4. Service Level Agreements (SLA)
ByteBooks guarantees a 99.99% uptime for core commerce functions (Point of Sale, Ledger execution). Scheduled maintenance will be communicated at least 48 hours in advance. In the event of an outage falling below the SLA threshold, affected enterprise tiers are eligible for service credits as outlined in your specific Enterprise Service Agreement.
5. Limitation of Liability
To the maximum extent permitted by law, ByteBooks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the Platform.
6. Compliance & Security
The Platform provides tools to assist with SOC2, GDPR, and localized tax compliance; however, you remain solely responsible for ensuring that your use of the Platform complies with all applicable laws and regulations in your jurisdiction.
